A contract will only come into existence between you the customer and us once your order has been processed and dispatched.

When you as a customer place an order via this website, you warrant by placing the order that:

1. You are not a minor or otherwise legally incapable of entering into a binding contract.
2. The personal details which you give us on registration are fully complete and accurate.
3. You are not using a false name or the name of any other person or body which you are not authorised to use.

By ordering from Sugar Rush Chigwell, you agree to be legally bound by these terms and conditions. Please note that these conditions may be modified or amended and posted on this website from time to time.

How to Order Our Products

As soon as you know the date of your party or event, please contact us. We recommend a minimum of one-week notification to complete your custom order. Please note that our weekend slots usually fill up pretty quickly. The easiest way to order any of our products is to make an order through our website (https://sugar-rush-chigwell.sumupstore.com) and request any personalisation or changes (may needed) at the time of check out. Or you can send us a message, requesting a no-obligation quote, through our social media pages (https://www.instagram.com/sugar_rush_chigwell/). The total price of your order depends on the number of servings, the complexity of the design, delivery and set up at the venue (if applicable).

Payment & Deposit 

All orders at Sugar Rush Chigwell are processed exclusively through our website and require full payment at checkout. We accept all major debit and credit cards, bank transfers and PayPal. Please note, orders will only be confirmed once full payment has been received via our website. By completing the payment process, customers agree to our terms and conditions as outlined on this page.

Product Information 

The images on the website are examples of our cakes and other products. All our products are handmade and can be ordered in different sizes from those shown on the website. Your cake may have variations from the website image. Any description applied to the products is only given by way of identification and does not constitute a sale by description. Any image provided as part of the description of similar products is given for illustrative purposes only. Given the nature of the products, minor variations of colour, taste and design may apply.

Cake Flavours and Fillings

At Sugar Rush Chigwell, each cake description includes details of the flavours, fillings, and jams we offer. Customers are encouraged to carefully review these descriptions and select their preferred options from the choices provided. If there are any flavours you would like which are not listed on our website or social media please email or message us.

Alteration 

If you have any queries or need to make any changes to an order please contact us immediately. Alterations and amendments must be submitted in writing. We will assess the request for an alteration, and endeavour to make alteration where possible dependant on the design and amount of notice given. We will let you know its effect on the price and any agreed timetable. Accepting any alterations is at the discretion of Sugar Rush Chigwell. Alterations requested less than 3 days before completion may be subject to a surcharge. It is your responsibility to check any quotes and invoices thoroughly before making payment. We reserve the right to change the design at any point if circumstances beyond our control compromise the quality of the finished product. e.g. weather conditions. You will be notified of any such changes and we will endeavour to keep any changes minimal.

Delivery & Collection Service 

We offer delivery within 5 miles of Chigwell, Essex. We will always endeavour to deliver within the given time slot, however unfortunately delivery timings cannot be guaranteed. Refunds will not be given for delayed deliveries. If in the unlikely event the delivery is delayed, we will always endeavour to deliver the cake to you as close as possible to the given delivery. Our standard delivery (costs £5.99) timings are from 9:00 to 18:00 hrs. One-hour delivery slot is sent the night before the delivery due date. 

If you have requested a precise delivery, or a delivery to a venue. We will endeavour to contact you before delivery is due. However this not always possible due to the high number of orders we receive. It is the customer's responsibility to assure that we deliver to their postcode or they can collect their cake from us in Chigwell, Essex. We assume no responsibility for any loss or damages caused by customer's arranging a party expecting a delivery that is not been paid for. We will not issue any refunds upon errors or misrepresentations done by the customers. 

A cake that cannot be delivered or collected due to an error or misrepresentation from the customer, shall be given to a charity of our or customer's choice on the following day. Due to the perishable nature of the cake, we will not be able to store your cake for more than 24 hrs. from the delivery or collection slot given.  

Damages

We cannot be held liable for any damages to the cake or products we have delivered once we have delivered, set up the cake at the venue or delivery location.

We offer prearranged collection at Chigwell, Essex. If the cake or products are collected from us, we cannot be held liable for any damages to the cake or products once you sign the delivery note.

The collection vehicle should have a flat surface and be clean and tidy. Please do not place the cake on a seat in the car, seats are slanted and can damage the cake. The cake should be placed either in the boot or the footwell of the car on a non-slip mat. Extra care should be taken when driving as some elements may be delicate. Sugar Rush Chigwell cannot take any responsibility for damage to cakes when collected and transported by the customers. The cake or products can be very fragile so we advise to drive very slowly and carefully. All our products are fragile and require care and attention when handling, storing and displaying. Please pay careful attention to our "Cake Care” instructions that will be provided with the cake.

After Delivery

All cakes and other products should be placed on a flat surface and stored at a refrigerator in the box provided. Freezing our cakes or other products is not recommended. Goods placed outside are liable to react to the temperature. In hot or humid weather there is the possibility of sugar decorations melting or damage to goods. Please note, we do not provide cake tables, tablecloths or cutting knives. It is your responsibility to provide these or check with the venue to ensure these items are provided. Please note all our products should be consumed within 2 days, this is advisory only. Please note, once cakes have been cut, the shelf life will be reduced. We recommend extreme caution if you are considering a cake decorated with chocolate for a summer party or event (May-September). We cannot accept responsibility for any melting of the cake once it has left our possession, as we have no control over the environment/venue temperature. However, we can advise you of designs that are less susceptible to melting and do everything within our control to reduce the impact on the cake.

Allergens

Sugar Rush Chigwell is NOT an allergy-free kitchen. We cannot guarantee that our products are free from ingredients that may affect those with food allergies. At Sugar Rush Chigwell we recognise the seriousness of food allergies and we recommend that you consider our allergens information before you place an order and that you have agreed to notify your guests of allergen risks. We reserve the right to decline any orders for clients with serious food allergies. Sugar Rush Chigwell will not assume any liability for adverse reactions to our products. Our cake products may contain wheat/cereals containing gluten, eggs, milk, tree nuts, peanuts, sesame, mustard, soybeans, lupin, sulphur dioxide/sulphites. Sugar Rush Chigwell’s cake products are freshly prepared and our ingredients come from factories that handle other allergens. Whilst we and our ingredients suppliers do take precautions, we cannot guarantee that any product is free from allergens due to the risk of cross-contamination.

Non-Edible Items, Ornaments, Toppers, Flowers

Sugar Rush Chigwell can customise cake toppers made from card paper or edible icing sheets at an additional cost. We reserve the right not to place ornaments on your cake if Sugar Rush Chigwell feels that doing so will cause damage to your cake. Please keep in mind that some flowers are harmful when eaten, and caution should be taken when selecting flowers to insert into cake. Sugar Rush Chigwell is not liable for any damage or illness caused by floral inserts into the cake. Most cakes contain small proportions of inedible items; it is the client‟s responsibility to ensure these are removed by your caterer/guests before consumption e.g. Support dowels in tiered cakes, ribbon, wires in sugar flowers, Swarovski crystals, flower picks & flower tape etc.

Colours & Design

Whilst an exact match of a provided picture cannot be guaranteed we will endeavour to meet your requirement as far as possible. Creating a cake is an art and may be subject to variations. This also applies to food colourings and icings. Colour matching is not a precise science and different sugar substrates take colour differently. We will do everything possible to match provided colour swatches, but sometimes it is not possible to make a 100% perfect colour match and some colours are just not achievable using food-grade dyes. We can only create your finished order from what we interpret from the wording of your order; therefore you must check everything is correct. We cannot match a “verbal” colour or a colour sent via an electronic device, as all monitors display colour differently. It may not be possible to create exact specifications when modelling food. However, we will work with you to ensure you are happy with the design.

Photography 

We will photograph all our cakes and reserves the right to take and use photographs of your cake(s) and desserts, before, during and after set up, including scene type photos of the event location, to use for marketing, advertising, and promotional purposes, without compensation to you.

Return, Refunds & Cancellations

Payments are non-refundable and non-transferable under any circumstances. However, customers may request to postpone the delivery of their order, provided at least 72 hours’ notice is given. 

Return

At Sugar Rush Chigwell, every order is custom-made or personalised to your specific requirements, ensuring each product is as unique as your celebration. As such, these orders are exempt from the standard right to cancel under the Consumer Contracts Regulations 2013.

Non-Return Policy

• Due to the bespoke nature of our products:
• Returns are not permitted unless the item is found to be faulty, damaged, or not as described at the time of delivery.
• If an issue arises, you must contact us immediately upon receipt of the product to resolve the matter. We may request photographic evidence to assess any claims.

Cancellation Policy

• Orders with less than 7 days’ notice, including same-day or next-day orders, are non-cancellable due to the preparation and production timeline required for custom orders.
• Customers may reschedule their order delivery with a minimum of 72 hours’ notice, subject to availability.

We aim to provide the highest quality service and products. If unforeseen circumstances arise that require us to cancel your order, we will notify you promptly and work with you to arrange a suitable alternative. If an alternative is not acceptable, we will issue a full refund.

Legal Compliance

This policy is designed to ensure clarity and fairness for all parties while adhering to the UK Consumer Contracts Regulations 2013 and Consumer Rights Act 2015.

Liability

We try to have the information on this website as accurate as possible but we make no warranties, whether express or implied, regarding its accuracy. We also do not make any warranties regarding any matters relating to the use of this website and it is a matter for you to ensure that your own equipment is protected from viruses or other external factors.

Your rights are protected by the Sale of Goods and Supply of Services Act, 1980, and also the Consumer Protection Act, 2007, where you are a consumer. Nothing in this website shall affect your rights under the applicable law.

Severance

If any of these terms and conditions shall prove to be void, unlawful, or unenforceable for any reason then such term or condition shall be deemed to be severed from the remaining terms and conditions which shall remain valid and enforceable.

If any provision of these terms and conditions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
